Terms of Use

Fukushima Prefecture (hereinafter referred to as “the Prefecture”) establishes the following terms of use (hereinafter referred to as “these Terms”) regarding the use of “Fuku no Sake,” a service for enjoying the top sake of Fukushima in Japan, provided by the Prefecture (hereinafter referred to as “Fuku no Sake”).

Purpose of Fuku no Sake

The main purpose of Fuku no Sake is to serve as a reference for viewers looking for restaurants in Fukushima Prefecture that offer sake, by publishing comments, images, and other information about restaurants posted by Fuku no Sake users (hereinafter, information posted by users to Fuku no Sake shall be collectively referred to as “Reviews”).

Changes to Content

The Prefecture may arbitrarily determine or change the contents of the service at any time.

Use of the Service

Users shall use the service (including services operated by parties other than the Prefecture; the same shall apply hereinafter) at their own risk. The Prefecture shall not be held liable for any damages incurred through the use of the service, or for any disputes arising between the service operators and users.

Regarding Use of Fuku no Sake

(1) Prohibition of Diversion and Resale of Fuku no Sake

Users shall not use or access all or any part of the Fuku no Sake service provided by the Prefecture for the purpose of business activities or other commercial acts, or any equivalent acts or preparations thereof. Furthermore, use or access for purposes such as religious or political activities is also prohibited.

(2) Changes to or Suspension of Fuku no Sake

The Prefecture may change the Fuku no Sake service provided to users at its own convenience. Please be aware that the service may be suspended in the event of a disaster, accident, or other emergency. The Prefecture will not provide any compensation for damages incurred by users or third parties due to changes to or suspension of Fuku no Sake without prior consent from the users.

(3) Requirements for Using Fuku no Sake

Access to the web is required to use Fuku no Sake. Users must prepare and operate the necessary equipment and software at their own responsibility and expense to access the web. The Prefecture is not involved in any way with the user’s preparations or methods for accessing the web.

Regarding the Posting of Reviews and Photos

By posting a review or photo, the user grants the Prefecture a royalty-free, worldwide license to use the content (including the right to reproduce, publicly transmit, distribute, translate, adapt, and sublicense to third parties) for the entire duration of the copyright.

Regarding Use Outside of the Service

The Prefecture, or a third party sublicensed by the Prefecture, may use user reviews as content on the Prefecture’s sites or affiliated sites. In such cases, parts of the user’s review may be summarized or excerpted, and posted photos (images) may be partially modified, such as by resizing or cropping. Additionally, when using a user’s review, the handle name used at the time of posting may be displayed. When the Prefecture or a third party sublicensed by the Prefecture uses a user’s review, there shall be no territorial restrictions, copyright notice obligations, or other ancillary conditions, and no royalties or other compensation shall be paid to the user. The Prefecture shall not provide any compensation for damages incurred by the user or a third party as a result of the use of the user’s review by the Prefecture or a third party.

Linking with External Services for Review Posting

(1) When posting a review on Fuku no Sake, if the user utilizes a function to link with external services such as Twitter or Facebook (hereinafter “External Services”), the user agrees in advance that the Prefecture will post the review to the External Service on the user’s behalf, and that in doing so, the Prefecture may add a URL to a webpage related to the review. Users may be asked for permission for the Prefecture to access their data when logging in via the linking function, and may only use the linking function if they have confirmed the details and granted permission. (2) All use of External Services, including the registration and use of a user ID for an External Service (and including the posting of the user’s reviews to the External Service), shall be subject to the terms and conditions stipulated by the operator of the External Service. (3) When using External Services, the user shall do so at their own risk. The Prefecture shall not be liable for any damages arising from the use of such services, any disputes with the operators or other users of such services, or any other matters related to such services.

Disclaimers

Fuku no Sake is to be used at the user’s own risk. Users are asked to acknowledge the following points in advance.

(1) Content of Reviews

The Prefecture makes no guarantees regarding the content of posted reviews. Please use them at your own discretion. The Prefecture will not provide any compensation for, nor be involved in, any damages incurred by users as a result of posted reviews (including damage from computer virus infections caused by content created by users) or any disputes between users.

(2) Linked Sites

The Prefecture makes no guarantees regarding sites operated by third parties that are linked from Fuku no Sake. Please use them at your own discretion. The Prefecture will not provide any compensation for, nor be involved in, any damages incurred on linked sites or any disputes between users.

Copyright, Property Rights, and Other Rights

(1) All copyrights, trademark rights, and other intellectual property rights and other property rights related to the content, individual information, trademarks, images, advertisements, designs, etc., included in Fuku no Sake belong to the Prefecture or their legitimate right holders. (2) All software used in Fuku no Sake and in connection with it contains property rights protected by laws and regulations concerning intellectual property rights. (3) Unless permitted by the Prefecture or a third party holding the copyright or other intellectual or property rights, or unless permitted by law without the right holder’s consent, users shall not reproduce, edit, modify, publish, reprint, publicly transmit, distribute, sell, provide, translate, adapt, or otherwise use or exploit Fuku no Sake or its contents in any way. (4) The Prefecture shall not be liable for any damages incurred by the user as a result of actions that violate the preceding paragraphs.

In the event that a user engages in acts that fall under the preceding paragraphs, or in acts that the Prefecture deems inappropriate in light of the purpose and objectives of Fuku no Sake

The Prefecture may take measures it deems appropriate against the user, such as suspending their use of Fuku no Sake (hereinafter referred to as “Suspension Measures”). Suspension Measures may be taken at the Prefecture’s discretion and judgment, regardless of whether the user is at fault, and the Prefecture will not disclose the reasons for such measures to the user under any circumstances. Furthermore, the Prefecture shall not be liable for any damages incurred by the user as a result of Suspension Measures.

Changes to these Terms

The Prefecture may change the contents of these Terms. In such cases, changes will be announced on Fuku no Sake or by other methods deemed appropriate by the Prefecture. Once announced, the changes will take effect, and users will be deemed to have accepted such changes.

Governing Law and Jurisdiction

The interpretation of these Terms shall be governed by the laws of Japan. In the event of a dispute regarding this service, the court having jurisdiction over the Prefecture shall have exclusive jurisdiction.
